Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Cork & Candles Franchising LLC (“ArtistryHost,” “we,” “us”) governing your access to and use of the ArtistryHost booking platform and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you are authorized to bind that business.

The Service

ArtistryHost provides software that lets businesses (“operators”) publish bookable experiences, take reservations and payments, manage their schedule and guests, and communicate with their customers. We provide the software; operators run their own businesses and are responsible for the experiences they offer and their relationships with their guests.

Accounts

• You must provide accurate information and keep it current.
• You are responsible for safeguarding your login credentials and for all activity under your account, including any team members you invite.
• You must be at least 18 years old and able to form a binding contract.

Free trial, subscriptions & fees

We may offer a free trial. After any trial, continued use of paid features requires a paid subscription. Subscription fees, billing frequency (monthly or annual), and any promotional pricing are presented when you subscribe and are billed through our billing provider. Fees are exclusive of taxes, which you are responsible for where applicable. Except where required by law or expressly stated, fees are non-refundable. We may change pricing prospectively with reasonable notice; changes do not affect the then-current paid term.

Payments to operators

Guest payments are processed through the operator’s own connected payment account (e.g. Square). ArtistryHost is not a party to the transaction between an operator and its guests, does not take possession of those funds, and is not responsible for an operator’s pricing, taxes, refunds, chargebacks, cancellation terms, or fulfillment. Each operator sets and is responsible for its own cancellation and refund policies.

Operator responsibilities

• Use the Service lawfully and provide accurate listings, pricing, and policies to your guests.
• Obtain any consents and provide any disclosures required for data you collect from guests or for any analytics or advertising tools you enable on your booking pages.
• Comply with applicable laws, including those governing consumer protection, taxes, payments, and marketing communications.
• You are responsible for the content you upload and for your relationship with your guests.

Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, deceptive, or fraudulent purpose.
• Interfere with or disrupt the Service, or attempt to gain unauthorized access to it or to other users’ data.
• Reverse engineer, resell, or misuse the Service except as permitted by these Terms.
• Upload malicious code or infringe the intellectual property or privacy rights of others.

Intellectual property

ArtistryHost and its software, design, and content are owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of the content you provide (such as your listings, photos, and guest data) and grant us a license to host and process it as needed to provide the Service.

Third-party services

The Service integrates with third-party services (such as Square, Stripe, and email providers). Your use of those services is subject to their terms, and we are not responsible for them.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, ArtistryHost will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve months before the event giving rise to the claim.

Indemnification

You will indemnify and hold harmless ArtistryHost from claims, damages, and expenses arising out of your use of the Service, your content, your relationship with your guests, or your violation of these Terms or applicable law.

Term & termination

These Terms apply while you use the Service. You may stop using the Service and cancel at any time. We may suspend or terminate access if you violate these Terms or to comply with law or protect the Service. Upon termination, your right to use the Service ends; provisions that by their nature should survive will survive.

Governing law

These Terms are governed by the laws of the State of Pennsylvania, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Pennsylvania will have exclusive jurisdiction over disputes, and you consent to their jurisdiction and venue.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and may ask you to re-accept. Continued use after changes take effect constitutes acceptance.
